Are You the Interdependent (Same Sex) Partner of an Australian Citizens or Permanent Residents Living In or Outside Australia! Spouse visas allows the same sex partner of an Australian Citizen or Permanent Resident, together with any of that person's dependent children to live and work in Australia. It is normal for the first visa to be a Provisional visa for 2 years. After two years, if the relationship is ongoing, then a Permanent visa will be granted. You will need to show that you have been living together in a relationship for at least 12 months to qualify. It you come from countries where same sex partnerships are not culturally acceptable, then if may be possible to apply if you have been together for less than 12 months. If you have been together for more than than five years then you may be granted a Permanent visa straight away. Spouse visas have been refused in cases where DIAC do not believe that your relationship is genuine and long term. Cases where there is a big difference between the ages of the partners, or where the interdependent partner comes from certain countries need to be carefully prepared and presented to DIAC.
